  1. DEFINITIONS
    1. Administrator – ePaństwo Foundation with headquarters in Warsaw at ul. Nowogrodzka 25/37, 00-511 Warszawa, Poland; KRS (National Court Register): 0000359730.
    2. Personal data – information about an identified or identifiable natural person; an identifiable natural person is a person who can be directly or indirectly identified, in particular on the basis of an identifier such as name and surname, identification number, location data, online identifier or one or several specific factors determining physical, physiological, genetic, mental, the economic, cultural or social identity of the natural person.
    3. Policy – this privacy policy.
    4. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC.
    5. Website – a set of websites made available by the Administrator on internet servers at the following addresses:

    6. User – any natural person visiting the Website, in particular any natural person using the services provided by the Service Provider on the Website;
  2. RULES FOR THE PROCESSING OF PERSONAL DATA
    1. The Administrator collects the User’s personal data in connection with his activities on the Website – in accordance with the principle of legality, purposefulness, limited processing, data minimization, accuracy, integrity and confidentiality.
    2. The administrator collects personal data for specific, explicit and legitimate purposes and does not further process them in a manner incompatible with these purposes.
    3. The scope of the User’s personal data collected by the Administrator is limited to what is necessary to enable the User to use the services provided on the Website.
  3. OBJECTIVES AND LEGAL BASIS FOR PROCESSING DATA ON THE WEBSITE
    1. USE OF THE WEBSITE BY USERS
      1. As part of each Service User’s visit to the Website, the Administrator downloads technical data of the User’s end device, such as IP address, page entry source, connection time, URL, and browser type and version.
      2. The administrator processes the above personal data for the purposes of:
        1. related to the provision of electronic services in the field of providing Users with content and functionality available on the Website – the legal basis for processing is the necessity of processing to perform the contract (Article 6 paragraph 1 point b of the GDPR);
        2. Administrator’s analytical and statistical data – the legal basis for processing is the Administrator’s legitimate interest (art.6 par.1 lit.f GDPR) consisting in conducting analyzes of Users’ activities, as well as their preferences in order to improve the functionalities and services provided;
        3. possible determination and pursuit of claims or defense against them – the legal basis for processing is the justified interest of the Administrator (Article 6 paragraph 1 letter f of the GDPR) consisting in the protection of the Administrator’s rights;
    2. ACCOUNT REGISTRATION ON THE ARCHIVES.IO, MOJEPRAWO.IO, REGISTER.IO AND SEJMOMETR.PL WEBSITE
      1. For the purpose of account registration on the website https://archiwum.io, https://mojeprawo.io/, https://rejestr.io/ and https://sejmometr.pl/, the User is asked by the Administrator to provide his e-mail address -mail or ID on Facebook or Google.
      2. Aforementioned personal data is processed in order to:
        1. servicing the account and providing services available on the website https://archiwum.io, https://mojeprawo.io/, https://rejestr.io/ and https://sejmometr.pl/ on the principles described in the regulations for the provision of services by electronic means – the legal basis is the necessity of processing for the performance of the contract (art.6 par.1 lit.b GDPR);
        2. establishing or pursuing any claims or defending against such claims by the Administrator – the legal basis for data processing is the Administrator’s legitimate interest (Article 6 paragraph 1 point f of the GDPR), consisting in the protection of the Administrator’s rights;
    3. NEWSLETTER
      1. For the purposes of receiving the newsletter, the User is asked by the Administrator to provide an e-mail address.
      2. Aforementioned personal data is processed in order to:
        1. performing the ordered newsletter sending service – the legal basis for processing is the performance of the contract (art.6 par.1 lit.b GDPR);
        2. directing marketing content in the form of a newsletter, using profiling (see point 3.3.3 below) – the legal basis is the legitimate interest of the Foundation (Article 6 (1) (f) of the GDPR), the legitimate interest of the Foundation is directing marketing content in the form newsletter, in connection with the User’s consent.
        3. possible determination and pursuit of claims or defense against them – the legal basis for processing is the justified interest of the Administrator (Article 6 paragraph 1 letter f of the GDPR) consisting in the protection of the Administrator’s rights;
      3. Profiling indicated in point 3.3.2.2. above consists in the automatic analysis of activities undertaken by the User in connection with the newsletter received (e.g. opening the newsletter or individual links contained in its content) and appropriate response to these activities e.g. by sending a reminder.
    4. WRITING APPLICATION
      1. For the purposes of using the Scriptures application, the User may provide his personal data.
      2. The administrator processes personal data in order to:
        1. carrying out the service of creating and sending letters via the mojepanstwo.pl website. – the legal basis for processing is the performance of the contract (art.6 par.1 lit.b GDPR);
        2. in order to possibly determine or pursue claims or defend against claims – the legal basis for processing is the legitimate interest of the Foundation (art.6 par.1 lit.f GDPR); the legitimate interest is to enable the Foundation to investigate or defend against claims.
    5. PERSONAL DATA FROM COMMONLY AVAILABLE SOURCES
      1. For the purposes of operating the Website, including the websites https://rejestr.io/; https://mojeprawo.io/ and https://sejmometr.pl/ The administrator collects personal data from publicly available sources such as:
        1. websites of the Sejm of the Republic of Poland and the Senate of the Republic of Poland;
        2. database of decisions of the Supreme Administrative Court;
        3. database of persons registered by the National Electoral Commission on electoral lists, in the process of organizing elections to public authorities in Poland;
        4. register of persons holding an academic title, kept by the National Research Institute;
        5. database of tenders awarded, maintained by the Public Procurement Office;
        6. database on registered patents maintained by the Patent Office of the Republic of Poland;
        7. register kept by the Institute of National Remembrance.
      2. Categories above personal data processed by the Foundation are the same as the categories of personal data disclosed in the abovementioned publicly available sources.
      3. The Administrator processes aforementioned personal data in order to make them available in applications and websites run by the Foundation to support the openness of the public sphere in Poland – the legal basis is the legitimate interest of the Foundation (art.6 par.1 lit.f GDPR), the legitimate interest of the Foundation is sharing personal data on websites run by the Foundation to support the openness of the public sphere in Poland.
    6. PERSONAL DATA FROM COMMONLY AVAILABLE SOURCES – NATIONAL COURT REGISTER AND JUDICIAL AND ECONOMIC MONITOR
      1. As part of the registry website, the administrator presents personal data collected from publicly available sources, i.e. the National Court Register and the Court and Economic Monitor.
      2. The categories of personal data processed by the Foundation are the same as the categories of personal data disclosed in the National Court Register and the Monitor Sądowy i Gospodarczy, in particular they are: names, surnames, date of birth, age, PESEL number, information about the functions performed by a person in the entity entered in the National Court Register, if any: number and value of shares held;
      3. The Administrator processes aforementioned personal data in order to make them available on websites run by the Foundation to support the certainty and transparency of business transactions, using profiling (see point 3.6.1.4.) – the legal basis is the legitimate interest of the Foundation (Article 6 paragraph 1 lit. f GDPR), the legitimate interest of the Foundation is sharing personal data on websites run by the Foundation to support the certainty and transparency of business transactions.
      4. Profiling, referred to in point 3.6.1.3., consists in the automatic analysis of the PESEL number in order to obtain information about the year of birth of persons whose data is processed, which allows the Administrator to introduce the functionality of displaying the year of birth of persons with the same first and last names (to distinguish them from other, equally named persons appearing in the National Court Register).
    7. COOKIES
      1. Cookies are IT data, in particular text files, which are stored on the User’s end device. Cookies usually contain: the domain name of the website from which they originate, their storage time on the end device and a unique number.
      2. The Administrator attempts to save cookie files each time the User visits the Website. The saved cookies are used by the Administrator in order to:
        1. adjusting the content of the Website to the User’s preferences and its optimization;
        2. maintaining the Website User’s session (after logging in), thanks to which the User does not have to re-enter the login and password on each subpage of the Website.
      3. Each User may not consent to the placement of cookies on his end device. To do this, use the option to disable the download and storage of cookies in your web browser.
      4. Deleting cookies may result in loss of some functionalities of the Website.
    8. MAKING DONATIONS
      1. The administrator on the Website provides the account number to which the User may make a donation.
      2. In the event of making a donation to the Administrator, the personal data provided by the User is processed in order to:
        1. performance of the donation contract – the legal basis for processing is the necessity of processing to perform the contract (art. 6 par. 1 lit. b GDPR);
        2. fulfillment of legal obligations incumbent on the Foundation on the basis of generally applicable legal provisions, including in particular accounting and tax law provisions – the legal basis is the fulfillment of the legal obligation incumbent on the Foundation (Article 6 paragraph 1 letter c of the GDPR);
        3. in order to possibly determine or pursue claims or defend against claims – the legal basis for processing is the legitimate interest of the Foundation (art.6 par.1 lit.f GDPR); consisting in the protection of Administrator’s rights.
    9. SOCIAL MEDIA
      1. In connection with the Administrator’s possession of accounts on social networking sites such as Facebook, Twitter, Instagram, LinkedIn, YouTube, Flickr, Meetup, the Administrator processes the personal data of Users who visit the Administrator’s accounts on the aforementioned portals.
      2. Aforementioned data is processed only in the scope of keeping the Administrator’s account on social networks. The legal basis for the processing of personal data by the Administrator for this purpose is his legitimate interest (art.6 par.1 lit.f GDPR) consisting in building the Administrator’s brand through social networking sites.
    10. RIGHTS OF PERSONS WHO THE DATA CONCERNS
      1. Each data subject has the right to access the data content and – in the cases specified by the GDPR – the right to request rectification, deletion, processing restrictions, the right to transfer data and the right to object to data processing, as well as the right to lodge a complaint to the supervisory authority dealing with personal data protection.
      2. Without prejudice to available administrative or extrajudicial remedies, including the right to lodge a complaint with a supervisory authority, any data subject shall have the right to an effective remedy before a court if he considers that his rights under the GDPR have been violated as a result of processing his personal data in violation of the GDPR.
    11. TRANSMISSION OF DATA OUTSIDE THE EEA
      1. Due to the fact that the level of personal data protection outside the European Economic Area (EEA) differs from that provided by the provisions of the GDPR, the Administrator transfers personal data outside the EEA only when necessary and with an adequate level of protection, primarily through:
        1. cooperation with entities processing personal data in countries for which an appropriate decision of the European Commission has been issued;
        2. use of standard contractual clauses issued by the European Commission;
        3. applying binding corporate rules approved by the competent supervisory authority;
        4. in case of transferring data to the USA – cooperation with entities participating in the Privacy Shield program approved by the decision of the European Commission.
